This User Agreement ("Agreement") is a contract between you and Enhanced Aim, LLC. and applies to your use of the Enhanced Aim Foum Services. If you do not agree to be bound by the terms and conditions of this Agreement, please do not use or access the Enhanced Aim Forums. Enhanced Aim LLC retains all rights not expressly granted by this Agreement. We may amend this Agreement at any time by posting the amended terms on our site. Except as stated below, all amended terms shall be effective 30 days after they are initially posted on our site. In this Agreement, "you" or "your" means any person or entity using the Service ("Users"). Unless otherwise stated, "Enhanced Aim," "we" or "our" will refer collectively to Enhanced Aim LLC. and its subsidiaries. This Agreement was last modified on June 4th, 2007. Eligibility. In order to use the Service, you must register for a Enhanced Aim forum account and purchase Enhanced Aim VIP access. Our Services are only available to individuals or businesses that can form legally binding contracts under applicable law. Without limiting the foregoing persons who are suspended from our Service based on these terms and conditions. Enhanced aim VIP Access refers to private forum access only and no such services there with-in. Enhanced Aim LLC is not liable for content available within the private section. The Legal Relationship between You and Enhanced Aim LLC. 2.1 No Warranty. WE, OUR PARENT, SUBSIDIARIES, EMPLOYEES AND OUR SUPPLIERS PROVIDE OUR SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY. WE, OUR PARENT, SUBSIDIARIES, EMPLOYEES AND OUR SUPPLIERS SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Enhanced Aim shall make reasonable efforts to ensure that Enhanced Aim forums and its incorporated services function as described. Some states do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you. This warranty gives you specific legal rights and you may also have other legal rights that vary from state to state. 2.2 Limitation of Liability. IN NO EVENT SHALL WE, OUR PARENT, SUBSIDIARIES, EMPLOYEES OR OUR SUPPLIERS BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH OUR WEBSITE, OUR SERVICE, OR THIS AGREEMENT (HOWEVER ARISING, INCLUDING NEGLIGENCE). Enhanced Aim LLC takes no responsibility for content provided in the VIP section by third parties. Some states do not allow the exclusion or limitation of incidental or consequential damages so the above limitation or exclusion may not apply to you. OUR LIABILITY, AND THE LIABILITY OF OUR PARENT, SUBSIDIARIES, EMPLOYEES AND SUPPLIERS, TO YOU OR ANY THIRD PARTIES IN ANY CIRCUMSTANCE IS LIMITED TO THE ACTUAL AMOUNT OF DIRECT DAMAGES. 2.3 Indemnification. You agree to indemnify and hold Enhanced Aim LLC, its parent, subsidiaries, affiliates, officers, directors and employees harmless from any claim or demand (including attorneys' fees) made or incurred by any third party due to or arising out of your breach of this Agreement or the documents it incorporates by reference, or your violation of any law or the rights of a third party relating to your use of the Service. Your Information and Restricted Activities 3.1 Definition. "Your Information" is defined as any information you provide to us or other users in your registration or use of other features of our Service. You are solely responsible for Your Information, as we act as a passive conduit for your online distribution and publication of Your Information. By signing up to use Enhanced Aim Forums, you agree that you will provide accurate information during the registration process. 3.2 Restricted Activities. Privacy and Security. We store and process Your Information on computers located in the United States that are protected by physical as well as technological security devices. You should only log in to your account on a page which begins with http://enhancedaim.com/. All of our pages begin with http://enhancedaim.com/ and therefore you should not use any other site that does not begin as such. If you object to Your Information being transferred or used in this way, please do not use our Services. Furthermore, Enhanced Aim strongly recommends using unique passwords for your enhancedaim.com accounts. Your Use of Enhanced Aim VIP ACCESS 4.1 Definition. "VIP Access" is defined as private forum access to the Enhanced Aim Forums location at http://www.enhancedaim.com/forums. You are solely responsible for any content that you view or use with-in the private forum section. 4.2 Payments and Refunds- All services provided by Enhanced aim LLC are physically completed immediately, or they are provided in a manner in which the service is completed immediately when any payment is sent and received. Therefore there are no refunds offered to anyone at anytime for any reason, as the services paid for have already been received. 4.3 IN NO EVENT SHALL WE, OUR PARENT, SUBSIDIARIES, EMPLOYEES OR OUR SUPPLIERS BE LIABLE for any content posted by users in the VIP Section/ Private forum. 4.4 User AGREES NOT TO DOWNLOAD, INSTALL, OR USE Any content contained with-in the Private Forums IN A COUNTRY OR LOCALE WHERE SUCH ACTION WOULD VIOLATE ANY LAW OR ORDINANCE 4.5 User AGREES THAT WE, OUR PARENT, SUBSIDIARIES, EMPLOYEES OR OUR SUPPLIERS SHALL NOT BE LIABLE FOR ANY CLAIM WHATSOEVER INVOLVING CONTENT posted by VIP members on Enhanced Aim website and forums. 4.6 Enhanced Risk Free Trial- The definition of the specified guarantee is that the Enhanced Aim VIP works as advertised. Any refund may only be claimed 15 days before the account expires. If the user wishes to claim a refund after the 15 day period, the refund will not be given. Users requesting a refund must also explain to Enhanced Aim LLC without a reasonable doubt why he/she was not satisfied with the service. Termination or Closing of Your VIP Account. You may close your account at any time by contacting us through Customer Service by logging into your Billing account and summitting a help ticket. Upon closure of a VIP ACCESS account, you will no longer be able to access any of the information stored therein. You will remain liable for all obligations related to your account even after such account is closed. Assignability. You may not transfer any rights or obligations you may have under this Agreement. Legal Compliance. You shall comply with all applicable U.S. and international laws, statutes, ordinances, regulations, contracts and applicable licenses regarding your use of our Services. Notices. 5.1 Electronic Communications. You agree that this Agreement constitutes "a writing signed by You" under any applicable law or regulation. To the fullest extent permitted by applicable law, this Agreement and any other agreements, notices or other communications regarding your account and/or your use of the Service ("Communications"), may be provided to you electronically and you agree to receive all Communications from Enhanced Aim LLC in electronic form. Electronic Communications may be posted on the pages within the Enhanced Aim website and/or delivered to your e-mail address. You may print a copy of any Communications and retain it for your records. All Communications in either electronic or paper format will be considered to be in "writing," and to have been received no later than five (5) business days after posting or dissemination, whether or not you have received or retrieved the Communication. Enhanced Aim LLC reserves the right but assumes no obligation to provide Communications in paper format. General. This agreement shall be governed by and construed in accordance with the laws of the State of Delaware, without giving effect to any principles of conflicts of law. Those who choose to access this Site and/or Service from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent that local laws are applicable. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between the parties relating to the subject matter herein. Enhanced Aim LLC may change the terms of this Agreement upon such advance notice, if any, as may be required by law.
